Terms of Service

These Terms of Service ("Terms") govern your use of the VIBE: AI Video Generator mobile application and website at www.aivideobest.com (collectively, the "Service"), operated by Rocket Digital Limited ("Company," "we," "our," or "us").

By downloading, installing, or using VIBE, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

1. Eligibility

You must be at least 13 years of age (or the minimum age required by law in your jurisdiction) to use VIBE. By using the Service, you represent that you meet this age requirement. Users under 18 should have parental consent.

2. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at hello@rocketdigital.ai if you suspect unauthorized access.

3. Subscriptions and Payments

VIBE offers free and premium (VIBE Pro) tiers. Subscriptions are managed through the Apple App Store, Google Play Store, and RevenueCat. By subscribing to VIBE Pro, you authorize us to charge your payment method on a recurring basis.

• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• Cancellations take effect at the end of the current billing period
• Refunds are subject to the policies of the Apple App Store or Google Play Store
• We reserve the right to modify pricing with reasonable advance notice

4. User Content and AI-Generated Content

Your Input

You retain ownership of text prompts and images you submit ("User Input"). By submitting User Input, you grant us a limited, non-exclusive license to process it through our AI systems solely to provide the Service.

AI-Generated Videos

Videos generated through VIBE using your prompts ("AI Output") are provided for your personal and commercial use, subject to these Terms and the terms of the underlying AI model providers. You are responsible for ensuring your use of AI Output complies with applicable laws.

Prohibited Content

You may not submit prompts or use VIBE to generate:

• Content that is sexually explicit or pornographic
• Content depicting minors in any sexual or harmful context
• Content designed to harass, defame, or threaten individuals
• Deepfakes of real people without their consent
• Content that violates copyright or intellectual property rights
• Content promoting violence, terrorism, or illegal activities
• Misinformation or deceptive content intended to mislead
• Content that violates any applicable laws or regulations

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Service
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service to scrape, crawl, or extract data without permission
• Use automated bots or scripts to generate excessive requests
• Sell, resell, or sublicense access to the Service without authorization
• Circumvent any usage limits, credit systems, or access controls
• Impersonate any person or entity
• Violate any applicable local, national, or international laws

6. Intellectual Property

The VIBE app, website, branding, and all original content (excluding User Input and AI Output) are owned by Rocket Digital Limited and protected by copyright, trademark, and other intellectual property laws. You may not use our branding or content without prior written permission.

AI model technologies used within VIBE are licensed from their respective providers (including but not limited to OpenAI, Google, Replicate, and Fal.ai) and are subject to their respective terms and policies.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. AI-GENERATED CONTENT MAY BE INACCURATE, INCOMPLETE, OR UNEXPECTED — YOU USE IT AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROCKET DIGITAL LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold harmless Rocket Digital Limited and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including legal fees) arising from your use of the Service, your User Input, or your violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at our discretion, without notice, if you violate these Terms or for any other reason. Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination will survive.

11. Third-Party Services

VIBE integrates third-party services including RevenueCat, Firebase, Google AdMob, OpenAI, Microsoft Azure, Replicate, Fal.ai, Google Analytics, and Meta Pixel. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Hong Kong.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.
